BID 97-040A AWARDED FOR CDBG-FUNDED HOUSING AUTHORITY OF
ELGIN'S CENTRAL PARK TOWER IMPROVEMENTS
Councilman Gavin made a motion, seconded by Councilman Walters,
to award this contract to the overall, low bidder, Elgin Sheet
Metal, for a total amount of $85,949 . Yeas : Councilmembers
Gavin, McKevitt, Schock, Walters, Yearman and Mayor Kelly.
Nays : None.
BID 97-063 AWARDED FOR HEMMENS PROSCENIUM REMODELING
Councilman Walters made a motion, seconded by Councilman Schock,
to award the base bid and all alternatives to Pacific
Construction Services using funding option #1 (uncommitted
Riverboat Lease proceeds) . Yeas : Councilmembers Gavin,
McKevitt, Schock, Walters, Yearman and Mayor Kelly. Nays : None.

Councilman Walters made a motion, seconded by Councilwoman
Yearman, to authorize execution of an agreement with Art Casting
of Illinois in the amount of $19,000 . Yeas : Councilmembers
Gavin, McKevitt, Schock, Walters, Yearman and Mayor Kelly.
Nays : None.
BID AWARDED FOR LORD'S PARK IMPROVEMENTS-PHASE I
Councilman McKevitt made a motion, seconded by Councilman
Schock, to award the bid to Sebert Landscaping for Phase I
improvements in the amount of $548, 289, to accept the bid
alternate for the fountain construction of $85,234 , for a total
contract of $606,523, and to use approximately $39 , 000 from the
Park Development Fund towards financing the project. Yeas:
Councilmembers Gavin, McKevitt, Schock, Walters, Yearman and
Mayor Kelly. Nays : None.

. SECTION 00500 - AGREEMENT FORM
GENERAL
= THIS AGREEMENT is made this 19th day of August
t -=i.-t 19 97 , by and between the City of Elgin, Illinois, a municipal
corporation, hereinafter called the- Owner, and
doing business as
Art Casting of Illinois, Inc. , :an Illinois
corporation, and hereinafter called the Contractor.
Now therefore in consideration of the mutual promises and .

covenants contained herein, the sufficiency of which is-hereby `'
acknowledged, the parties hereto hereby agree as follows :
Contract Documents : -
The Contract Documents consist of this Agreement; the General
and Supplementary Conditions of the Contract and Specifications
as listed in the Index to the Project Manual; Performance,
Payment, and other Bonds; Instruction to Bidders ; Schedule of
Unit Prices as completed in the Bid Form; CDBG Wage Rates; and
all Exhibits of this Agreement; the Drawings as listed in the
Index to the Drawings; all Addenda issued prior to and all
Change Orders issued after execution of this Agreement. These
form the Contract and all are as fully a part of the Contract as
if attached to this Agreement or repeated herein.

and Change Orders .
Scope of Work:
The Contractor shall perform all work required by the Contract
Documents for Lords Park Fountain Project "Statue Recasting" .
Contract Time:
The contractor shall begin work within days after the , ' >

complete_ ( for Owner' s beneficial use) the Project within
months after written Notice to Proceed and fully complete all
work by May 9, 1998 a€t.cr written Notice to Proceed.
Liquidated Damages :
Should Contractor fail to perform the work within the periods of
time stipulated in the Agreement, Contractor shall pay to Owner,
as liquidated damages for delay and not as a penalty, but as
fixed liquidated damages due owner because of owner' s loss of
income and other costs incurred resulting from the failure to
complete the work within the time specified for substantial
completion, the sum of $200 . 00 per calendar day including
Sundays and Holidays, for each calendar day that the work shall
remain incomplete unless the contract time is extended in
writing by the Owner.

any other legal remedies otherwise available to it in the event
of any breach of the terms- of this agreement by Contractor,
specifically including, but riot limited to, collection of any

Owner shall have the right to -deduct the liquidated damages plus
additional engineering costs as set forth in the following
paragraph from any money in its possession, otherwise due, or to
become due, to Contractor, or to sue for and recover
compensation for damages for nonperformance of this contract
within the time stipulated.
Contract Price:
The Owner shall pay the Contractor in current funds for the
performance of the Work, subject to additions and deductions by
Change Order, the Total Contract Price of Nineteen Thousand
Dollars ( $ 19,000.00 )
Payments :
The Owner shall make payments as provided in the General
Conditions and Supplementary Conditions .
Retainaqe :
The Owner shall retain no less than ten percent ( 10%) of the
amount of each payment until final completion and acceptance of
- all work covered by the Contract Documents . In the event of any
conflict between the terms of this paragraph and the ordinances
of the Owner, the terms of said ordinances shall take precedence.
IN WITNESS WHEREOF, the parties hereto have executed this
Agreement the day and year first above written.

SUBJECT: Recasting of the Lords Park Fountain Statue
PURPOSE
The purpose of this memorandum is to provide the Mayor and
members of the City Council with information to consider the
bid award for the recasting of the Lords Park fountain statue
to Art Casting of Illinois .
BACKGROUND
In August 1897 , the original fountain and statue were donated
to the City of Elgin by Cook Publishing Company. The fountain
t statue survived the devastating pavilion fire in September of
1897, but over the years has experienced deterioration.
During the late 1960 ' s, the fountain was removed and the
statue was placed on display for a number of years in the
Lords Park Zoo. Due to its age, the original statue is too
fragile to be restored and, therefore, must be recast.
Eight bid packages were sent out to sculptors and foundries
that specialized in sculpture casting. On July 17 , 1997 , four
bids were opened, as detailed on the attached tabulation
sheet; the lowest bid was received from Art Casting of Illi-
nois, Inc. totaling $19,000 .
During the last few years, the Lords Park Association "Bring
Back the Fountain" Committee has been working to raise funds
to replace the fountain and statue through donations and the
selling of engraved bricks . The City of Elgin in 1996 ap-
proved $15, 000 in matching funds towards this project.

FINANCIAL IMPACT
r. Sufficient funds are available in the designated fountain
restoration account number 010-0000-231 . 75-00, project number
509542 . The total available funding for this project is
$56,661, including the City' s contribution of $15,000 .

It is recommended that the Mayor and members of the City
Council authorize execution of an agreement with Art Casting
