AGREEMENT
This agreement entered into this 2 S 41 day of ru,1 A.D. , 1980
by and between the STATE OF ILLINOIS, acting by and through its Dkpartment of Transportation
hereinafter called the STATE, and the CITY OF ELGIN, of Cook and Kane County, of the State c
Illinois, hereinafter called the CITY.
WITNESSETH:
WHEREAS, the STATE, in order to facilitate the free flow of traffic and insure safety
to the motoring public, is desirous of improving the intersection of Illinois Route 58
(FAP Route 557) and Hiawatha Drive by replacing temporary traffic control signals with
permanent traffic control signals (to be known as STATE Section 580TS-79 and as CITY
Section 80-00114-00-TL) , installing emergency vehicle pre-emption equipment, and by
performing all other work necessary to complete the improvement in accordance with the
plans and specifications; and,
WHEREAS, the CITY is desirous of said improvements in that same will be of immediate
benefit to the residents of the CITY, and permanent in nature; and,
WHEREAS, the intersection of Illinois Route 58 and Hiawatha Drive lies within the
corporate limits of the CITY.
NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties
hereto agree as follows:
1. The STATE agrees to prepare plans and specifications, receive bids, award the contract,
furnish engineering inspection during construction, and cause the improvement to be
built in accordance with the plans, specifications, and contract. The STATE also
agrees to pay all construction and engineering costs subject to reimbursement by the
CITY as hereinafter stipulated.
2. The CITY agrees to approve the plans and specifications by letter or resolution prior
to the STATE advertising for the work to be performed hereunder.
3. It is mutually agreed that the proportional participation for the construction costs
and engineering costs of these improvements shall be as follows:

4. It is mutually agreed that the estimated construction costs and engineering costs of
these improvements are as follows:

5. It is mutually agreed that the CITY will reimburse the STATE in an amount
equal to the CITY'S share of the actual cost as determined in accordance
with Item 3 above. It is mutually agreed that upon award of the contract
for this improvement, the CITY will pay to the Department of Transportation
of the State of Illinois, in a lump sum from any funds allotted to the CITY,
under the Motor Fuel Tax Law, an amount equal to 95% of its obligation
incurred under this agreement, and will pay to the said Department the
remainder of its obligation (including any non-participating costs for FA
projects) in a lump sum, upon completion of the project based upon final
costs.
6. The CITY has passed a resolution appropriating sufficient funds to pay its
share of the cost of these improvements, a copy of which is attached hereto
as "Exhibit A" and made a part hereof.
7. It is mutually agreed that the financial responsibility for the maintenance
of the permanent traffic signals and the energy charges for the operation of
the permanent traffic signals shall be borne entirely by the CITY.
8. It is mutually agreed that the maintenance and the financial responsibility
for the maintenance costs and energy charges for the operation of the emergency
vehicle pre-emption equipment shall be borne entirely by the CITY.
9. Upon the completion of this improvement, the CITY will be responsible for the
maintenance of the permanent traffic signals.
10. Upon the completion of this improvement, the CITY shall be responsible for
the maintenance of the permanent traffic signals in a manner satisfactory to
the STATE. Such maintenance shall be in accordance with the Traffic Signal
Maintenance Provisions attached hereto as "Exhibit B" and made a part hereof.
The STATE reserves the right to take over the maintenance of the traffic
signals upon giving the CITY a written notice not less than thirty days in
advance. From that day forward the STATE will send an itemized invoice to
the CITY every three months for the maintenance cost of the traffic signals
during the preceding period. Upon receipt of said invoice, the CITY agrees
to pay to the STATE the amount of the invoice by certified check made payable
to the Treasurer, State of Illinois, and remit same to the District Engineer,
Illinois Department of Transportation, 1000 Plaza Drive, Schaumburg, Illinois
60196.
11. The STATE agrees to make arrangements with the local power company to furnish
electrical energy for the operation of the traffic signals and to bill the
CITY for the entire cost of the energy charges.
12. The STATE retains the right to control the sequence and timing of the traffic
signals.

. 13. The CITY has adopted and will put into effect, prior to advertising for the
work to be performed hereunder, an ordinance requiring that parking be pro-
hibited adjacent to this improvement on the approaches lying within the
corporate limits of the CITY, a copy of which is attached hereto as "Exhibit
C" and will, in the future, prohibit parking at such locations on or im-
mediately adjacent to this improvement as may be determined to be necessary
by the STATE from traffic capacity studies.
14. The CITY agrees to exercise its franchise right to cause private utilities
to be relocated at no expense to the STATE.
15. The STATE agrees to comply with all applicable Executive Orders and Federal
Highway Acts pursuant to the Equal Employment Opportunity and Nondiscrimination
Regulations required by the U.S. Department of Transportation.
16. This agreement and the covenants contained herein shall become null and void
in the event the contract covering the construction work contemplated herein
is not awarded by June 30, 1983.
17. This agreement shall be binding upon and inure to the benefit of the parties
hereto, their successors and assigns.

EXHIBIT A
WHEREAS, the City of Elgin has entered into an Agreement with the State of
Illinois for the installation of traffic control signals at the intersection of
Illinois Route 58 (Summit Street) at Hiawatha Drive, known as STATE Section 580TS-79
and as CITY Section 80-00114-00-TL; and,
WHEREAS, in compliance with the aforementioned Agreement, it is necessary for
the CITY to appropriate sufficient Motor Fuel Tax Funds to pay its share of the cost
of said traffic signal installation.
NOW, THEREFORE, BE IT RESOLVED, that there is hereby appropriated the sum of
TEN THOUSAND FIVE HUNDRED AND NO/100 DOLLARS ($10,500.00) or so much thereof as may
be necessary, from any money now or hereinafter allotted to the CITY, under provisions
of the Motor Fuel Tax Law, to pay for its share of the cost of this improvement as
provided in this Agreement; and,
BE IT FURTHER RESOLVED, that upon award of the contract for this improvement, the
CITY will pay to the Department of Transportation of the State of Illinois, in a lump
sum from any funds allotted to the CITY, under the Motor Fuel Tax Law, an amount equal
to 95% of its obligation incurred under this Agreement, and will pay to the said De-
partment the remainder of its obligation (including any non-participating costs for
FA projects) in a lump sum, upon completion of the project based upon final costs; and,
BE IT FURTHER RESOLVED, that the CITY agrees to pass a supplemental resolution
to provide necessary funds for its share of the cost of this improvement if the
amount appropriated herein proves to be insufficient to cover said cost.

TRAFFIC SIGNAL MAINTENANCE PROVISIONS
The CITY shall:
1. Inspect the traffic signal installation(s) a minimum of once every two (2) weeks
for proper alignment of signal heads, lamp failures, and general operation of the traffic
signals.
2. Keep signal posts, controller pedestals, and foundations in alignment at all times.
3. Keep signal posts and controller cabinets tight on their foundations.
4. Keep signal heads securely mounted to their posts and properly adjusted.
5. Keep detector equipment in proper working order at all times.
6. Check all controllers every four (4) weeks, which will include visual inspection of all
timing intervals, relays, detectors, and all components of any form of pre-emption equip-
ment to insure that they are functioning properly, Make all necessary repairs and
replacements.
7. Provide immediate corrective action to replace" burned-out lamps or damaged sockets. When
lamps are replaced, the reflector and lens shall be cleaned. All replacement lamps shall
• equal the wattage and type of the existing lamp.
8. Provide immediate corrective action when any part or parts of the system fail to function
properly. Two far-side heads facing each approach shall be considered the minimum accept-
able signal operation pending permanent repairs. When the distance from the stop line to
the far-side signal exceeds 120 feet, a near-right signal must also be maintained. When
repairs at a signalized intersection require that the controller be disconnected and power
is available, the traffic signal installation shall be placed on flashing operation, or
a flasher installed if none is provided in the controller cabinet. The signals shall
flash RED for all directions unless a different indication has been specified in the
sequence of operations and a stop sign (R1-1-36) placed at each approach to the inter-
section as a temporary means of regulating traffic. Stop signs will not be required at
approaches where a Yellow Flashing indication is included in the sequence of operations.
9. Keep interior of controller cabinets in a neat and workmanlike manner at all times.
10. Clean reflectors, lenses, and lamps once every six (6) months.
11. Repaint all signal components exposed to weather at least once every three (3) years.
12. Group relamp traffic signal heads at the expiration of the average-rated lamp life.
13. Upon notification of a malfunction in the traffic signal sequence of operation, and if
the proper sequence with full detection cannot be obtained immediately, a controller
which will provide the proper sequence and full detection shall be installed within
twelve (12) hours of removal of the original controller.
14. Remove to clean, test, lubricate, and overhaul as required, each electrical, mechanical,
and electromechanical component of each installation, at intervals not exceeding twelve (12)
months, except service installations, magnetic detectors, and pressure detectors. The
master control equipment for traffic-adjusted systems may be cleaned and overhauled without
removal from the site. A record tag shall be attached to each individual piece of equipment
with the following information: (1) date of -overhaul and (2) the location where originally
installed. The interval between successive dates of cleaning and overhauling shall not
exceed one year. Any component unit which fails in a manner which affects the intended
operation of any installation shall be overhauled before it is returned to service. The
existing type of equipment and sequence of operations shall be maintained during the
period of time that the original control equipment is being overhauled. When solid-state
controllers malfunction, they shall be removed, repaired, and bench checked. Solid-state
controllers shall not be removed for annual maintenance inspections.
15. Repair or replace any and all equipment damaged by any cause whatsoever.
16. Be responsible to make recovery for damage to any part of the installation or systems from
the party causing the damage.
17. Respond to emergency calls twenty-four (24) hours a day including Saturdays, Sundays, and
holidays. . Controller failure, lights out, knockdowns, or two (2) red lights out on an
intersection approach are considered emergencies.
18. Provide the STATE the names, addresses, and telephone numbers of at least two persons who
will be available for emergency repair of the traffic signals and shall keep the STATE
informed of any changes of same.
PLAN APPROVAL
WHEREAS, in order to facilitate the improvement at the intersection
of Illinois Route 58 and Hiawatha Drive, the CITY OF ELGIN hereby
approves the plans and specifications for the proposed permanent
traffic signal installation at the said intersection.

PROHIBITING PARKING ON A PORTION OF SII+IIT STREET AND HIAWATHA DRIVE
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS:
Section 1. That Title 11, Chapter 11.36 of the Elgin Municipal Code,
1976, as amended, is hereby amended by adding to the designated places
where parking is prohibited under Section 11.36.050M the following:
Summit Street, both sides, from the Kane/Cook County Line
to 300 feet east of Hiawatha Drive.
Hiawatha Drive, both sides, from 100 feet south of Summit
Street to 100 feet north of Summit Street.
Section 2. That all ordinances or parts of ordinances in conflict
with the provisions of this ordinance be and are hereby repealed.
Section 3. That this ordinance shall be in full force and effect
from and after its passage and publication in the manner provided by law.
