RESOLUTION NO. 76-133
AUTHORIZING MEMORANDUM OF AGREEMENT WITH CITY OF ELGIN
FOR CONSTRUCTION OF BIG TIMBER ROAD
FROM ILLINOIS ROUTE 31 EASTERLY ACROSS FOX RIVER TO DUNDEE AVENUE
WHEREAS, the City of Elgin has heretofore requested the County of Kane
to enter into a joint agreement for the construction of Big Timber Road from
Illinois Route 31 easterly across the Fox River to Dundee Avenue; and
WHEREAS, such improvements will facilitate the east-west traffic flow,
including an additional crossing of the Fox River, for the northerly area
of the City of Elgin and will be of immediate benefit to the residents of
the County of Kane and permanent in nature.
NOW, THEREFORE, BE IT RESOLVED by the County Board of the County of Kane
that the Chairman of the County Board be, and is hereby authorized and directed
to execute on behalf of the County of Kane the Memorandum of Agreement between
the City of Elgin and the County of Kane for the project herein stated.

WITNESSETH
WHEREAS, the CITY, in order to facilitate the east-west traffic flow including
an additional crossing of the Fox River by extending Big Timber Road (County Highway
21) from the intersection with Illinois Route 31 easterly across the Fox River to
the south side of Summit Street and thence easterly to beyond Dundee Avenue follow-
ing the alinement prepared by H.W. Lochner, Inc. dated July 7, 1976; and,
WHEREAS, the CITY and COUNTY are desirous of said improvements in that same
will be of immediate benefit to the residents of the CITY and COUNTY and permanent
in nature; and,
NOW THEREFORE, in consideration of the mutual covenants contained herein, the
parties hereto agree as follows:
(1) The CITY agrees to prepare the plans, specifications and estimates for such
construction and shall submit same to the COUNTY and to the Department of
Transportation, Division of Highways, State of Illinois for review and
approval.
(2) The CITY agrees to receive bids, and upon approval by the COUNTY and the
STATE, award the contract, furnish engineering inspection during construc-
tion, and cause the improvement to be built in accordance with the plans,
specifications, and contract.
(3) The CITY and COUNTY agree to pass resolutions appropriating sufficient
funds from Motor Fuel Tax Funds or other local funds to pay their appor-
tionate share of the cost of this improvement.
The COUNTY will, from time to time, issue warrants payable to the CITY, for
amounts equal to the payment recommended on monthly payment estimates as submitted
by the CITY to cover the COUNTY'S share of the cost of right-of-way, construction
and engineering services. Upon completion of the construction and approval by the
COUNTY and STATE, the COUNTY will issue warrants payable to the CITY for the balance
of its share of the total project.
(4) It is mutually agreed that the cost of the improvement shall be borne
equally between the CITY and the COUNTY on a 50-50 basis for right of
way costs and aquisition, construction and engineering costs for that

the event the contract covering the construction work contemplated herein
is not awarded by January 1, 1983.
(7) This agreement shall be binding upon and inure to the benefits of the parties
hereto, -,their successors, and assigns. •
