HomeMy WebLinkAbout76-0414 St. Charles Street -46—°411 RESOLUTION APPROPRIATING FUNDS FOR THE INSTALLATION OF TRAFFIC SIGNALS AT ST. CHARLES STREET AND MAY STREET WHEREAS, the City of Elgin has entered intO an Agreement with the State of Illinois for the installation of traffic signals at the intersec- tion of St. Charles Street and May Street, knowr. as State Section SRS-000S(53) , City Section 76-00095-00-TL; and WHEREAS, in compliance with the aforementibned Agreement, it is necessary - for the City of Elgin to appropriate sufficient funds to pay its share of the cost of said improvement. NOW, THEREFORE, BE IT RESOLVED that there s hereby appropriated the sum of Five Thousand and 00/100 Dollars ($5,000 00) , or so much thereof as may be necessary, from any money now or hereinafter allotted to the City of Elgin, to pay its share of the cost of this improvement as provided in the Agreement; and BE IT FURTHER RESOLVED, that upon receipt bf the contractor's first and subsequent progressive bills, the City of Elgin will pay to the Department of Transportation of the State of Illinois, from any funds allotted to the City, an amount equal to ten per cent (10%) of the actual progress payment (appropriately adjusted for non-participating lsts for Federal-Aid projects) made to the contractor, until the entire obliga ion incurred under the Agree- ment has been paid. BE IT FURTHER RESOLVED, that the City of Elgin agrees to pass a supple- mental resolution to provide the necessary funds for its share of the cost of this improvement if the amount appropriated herein is insufficient to cover said cost. s/ Richard L. FEDERAL - AID SAFETY AGREEMENT THIS AGREEMENT is made and entered into between the CITY OF ELGIN , hereinafter referred to as the MUNICIPALITY, and the STATE OF ILLINOIS, acting by and through its Department of Transportation, hereinafter referred to as the STATE. WHEREAS, the STATE and the MUNICIPALITY jointly propose to improve the exist- ing SCHOOL signals at the intersection of ST. CHARLES STREET and MAY STREET in the MUNICIPALITY, said improvement to be designated s,AD as STATE Section SRS-000S(53) , CITY Section 76-00095-00, , and to be constructed in accordance with plans approved by the STATE under the STATE'S FAUS Procedures approved by the U.S. Department of Transportation, n FERAL HIGHWAY ADMINISTRATION, hereinafter referred to as the FFWA; and WHEREAS, the Federal Highway Safety Program of the U.S. Department of Transportation makes certain funds available for participation in the cost of the proposed improvement. NOW, THEREFORE, in consideration of the mutual covenants contained herein, the parties hereto agree as follows: 1. The MUNICIPALITY agrees: a. Where applicable, to use a portion or all of the Federal Aid Safety funds allocated to them. b. To obtain all right-of-moray necessary for this project in accordance with the requirements of Titles II and III of the Uniform Relocation Assistance and Real Property Acquisition Policies Act of 1970, (The MUNICIPALITY, prior to the STATEN'S advertising for bids, will certify to the STATE that all requirements of this Act have been fulfilled) . c. To provide for all utility adjustments. • d. To provide for surveys and preparation of plans for the proposed improvement, and engineering supervi-ion during its construction. e. When on a Federal-Aid route, to main -in, or cause to be maintained, the completed improvement in a mann- satisfactory to the STATE and the FHWA. f. To regulate the use of the right of -y of this improvement by utilities, public and private, in ac'•rdance with the current UTILITY ACCOMMODATION POLICY FOR FED3r AID WORK AND MFT CONSTRUCTION PROJECTS FOR COUNTY AND TOWNSHIP HIe+ PAYS AND CITY STREETS IN ILLINOIS. 2. The State agrees: • a. To request the FHW to approve the p oposed improvement for Federal-Aid participation. b. To receive bids for the construction of the proposed improvement when: (1) all right-of-way has been secured; (2) provisions have been made, if required, for the improvement of any railroad-highway grade crossing and rail crossing protection within the limits of. the proposed improvement; (3) the plans have been approved by the STATE and the FHWA. c. To award a contract for construction of the proposed improvement, after receipt of a satisfactory bid and after concurrence in the award has been received from the MUNICIPALITY. d. To provide the STATE'S share to supp ement the Federal funds, if • applicable. e. To bill the MUNICIPALITY for their share of the costs in accordance with the provisions covering the division of cost set forth under Section 3(a) of this AGREEMENT. f. To observe land acquisition activities and conduct, along with FHWA, periodic canplience reviews. 4 ` 3. The MUNICIPALITY and the STATE mutually ee: a.
