NELSON BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS that Richard L. Verbic, Mayor, and Marie Yearman, City Clerk, be and is hereby authorized and directed to executed and attest respectively, for and on behalf of the City of Elgin, an employment agreement with Leo I. Nelson, City Manager, a copy of which is attached hereto and made a part hereof by reference. s/ Richard L. Verbic Richard L. NELSON, has been employed by the City of Elgin as * its City Manager for a period in excess of three years , and WHEREAS , said LEO I . NELSON, has performed the duties of the City Manager in a highly competent and satisfactory manner, and WHEREAS , it is the desire of the City of Elgin to continue to employ said LEO I. NELSON as City Manager upon certain terms and conditions , and WHEREAS , said LEO I . NELSON desires to continue to serve as the City Manager of the City of Elgin upon certain terms and conditions . NOW, THEREFORE, for and in consideration of the mutual covenants contained herein in the City of Elgin and LEO I. NELSON agree as follows : 1. That for and in consideration of the annual salary established by ordinance of the City of Elgin as it may be amended from time to time , and the other terms and conditions contained herein, LEO I. NELSON agrees to act as City Manager of the City of Elgin and to exercise all the powers and to carry out to the best of his ability all the duties imposed upon him as City Manager by the Statutes of the State of Illinois and the Ordinances of the City of Elgin including the following: (1) To enforce the laws and ordinances within the municipality; (2) To appoint and remove all directors of departments upon no basis other than that of merit and fitness ; (3) To exercise control of all departments; (4) To attend all meetings of the City Council with the right to take part in the discussions , but with no right to vote; (5) To recommend to the council for adoption such measures as he may deem necessary or expedient; (6) To perform such other duties as may be prescribed by statute or may be required of him by ordinance or resolution of the city council. . . 0 2. That this contract shall be subject to the managerial form of government, and amendments thereto and all ordinances passed by the City of Elgin. 3. That this agreement is for an indefinite term and may be terminated by LEO I . NELSON upon the giving of notice, in writing, to the City Council of the City of Elgin at least 30 days before the effective date of said termination. 4. That this contract may be terminated by the City of Elgin by a majority vote of the City Council . 5. In the event this contract is terminated by the City of Elgin, as herein stated, LEO I. NELSON shall be entitled to severance pay equal to one month of the annual salary established for the position of City Manager at the time of termination for each • year of service as City Manager including said service that may have been rendered prior to the execution of the agreement. However, severance pay shall not exceed a sum equal to six months salary. Any severance pay shall be in addition to all other pay, allowances , benefits or other emoluments payable to LEO I. NELSON at the time of termination of this agreement including, but not limited to accumulated vacation pay , sick pay or earned salary. 6.
