HomeMy WebLinkAbout76-0225 Kane County - Big Timber e1 RESOLUTION APPROVING A JOINT KANE COUNTY/CITY OF ELGIN AGREEMENT FOR THE IMPROVEMENT TO BIG TIMBER ROAD NEAR ILLINOIS ROUTE 31 WHEREAS, the County Board of Kane County, Illinois, in order to facilitate the free flow of traffic and to promote safety to the motoring public, desires to widen to four lanes a portion of Big Timber Road (County Highway 21) near Illinois Route 31 in Elgin, Illinois; and WHEREAS, the City of Elgin agrees to cause the improvements to be made. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF ELGIN, ILLINOIS that Leo I. Nelson, City Manager, and Marie Yearman, City Clerk, are hereby authorized and directed to execute and attest respectively, on behalf of the City of Elgin, a joint agreement between the City of Elgin and the County of Kane, a copy of which is attached hereto and made a part hereof by reference. WITNESSETH WHEREAS, the CITY, in order to facilitate the free flow of traffic .and insure safety to the motoring public is desirous of improving Big Timber Road (County Highway 21) near the intersection with Illinois Route 31 by widening to tour lanes, including curb and gutter and by performing all other work necessary to complete the improvement in accordance with the plans and specifications under City Section and County Section 75-00150-01-4R; and, WHEREAS, the CITY and COUNTY are desirous of said improvements in that same will be of immediate benefit to the residents of the CITY and COUNTY and permanent in nature; and, NOW THEREFORE, in consideration of the mutual covenants contained herein, the parties hereto agree as follows: (1) The CITY agrees to prepare the plans, specifications and estimates for such construction and shall submit same to the COUNTY and to the Department of Transportation, Division of Highways, State of Illinois for review and approval. (2) The CITY- agrees to receive bids, and upon approval by the COUNTY and the STATE, award the contract, furnish engineering inspection during, construc tion, and cause the improvement to be built in accordance with the plans, specifications, and contract. (3) The CITY and COUNTY agree to pass resolutions appropriating sufficient funds from Motor Fuel Tax Funds or other local funds to pay their share of the cost of this improvement. The COUNTY will, from time to time, issue warrants payable to the CITY, -- - for amounts equal to the payment recommended on monthly payment estimates as submitted by the City's Engineer to cover the COUNTY's share of the cost of construction and engineering services. Upon completion of the • construction and approval by the COUNTY and STATE, the COUNTY will issue warrants payable to the CITY for the balance of its share of the total project, including engineering. _ is not awarded by January 1, 1977.
